Booking terms and conditions

1. Introduction

Chalet Chef Deliveries (CCD) provides a service for its clients as advertised on the website. These terms and conditions, together with the booking form, constitute the contract between CCD and the Client. The contract shall exist once all relevant payments have been received and a confirmation and invoice has been sent to you by us.

2. Provision of Services

This agreement is made between CCD and the Client on the basis that the services, as specified, are to be provided for CCD’s Clients for a period as defined by the Confirmation Letter (the 'Hire Period'). The price of the services is as specified in Confirmation Letter (the 'Full Payment'). The deposit is as specified in the Confirmation Letter (the 'Deposit') and should accompany all bookings. The balance of the Services price must be paid at least 4 weeks before the beginning of the Hire Period. If the balance of the Services is not received within these periods then the deposit may be forfeited and the hiring cancelled at the sole discretion of CCD. If bookings are made 4 weeks or less in advance of the Hire Period the whole of the Services Price must be paid on booking.


3. Hire Periods

Hire periods will run from the time and date specified in the Confirmation Letter, with access to the property (if required, for example, but not exclusively, for staffed events) to be available as arranged by CCD staff with the Client. The Hirer agrees to make every effort to arrange access at the Property (or to be at meeting points promptly) by the specified time; however, any failure to notify CCD of a late arrival resulting in failure by CCD to provide Services, will result in responsibility for alternative services lying with the Hirer.


5. Rights of Refusal

Unique reserves the unconditional right to terminate a provision of services with immediate effect in the event of unreasonable conduct by the Hirer which is - in CCD’s reasonable opinion - likely to cause distress, damage, danger or annoyance to other customers, employees, property or to any third party. CCD’s responsibility for the Hirer's services thereupon ceases. Full cancellation charges will apply and CCD will be under no obligation whatsoever for any refund, compensation or loss that the Hirer may incur.


6. Descriptions

Every effort is made to ensure that all descriptions made of the services are accurate, however CCD cannot accept any liability for any inaccuracies or changes that may occur between the time of the Booking and the Hire Period.


7. Liability

The Hirer accepts that they use the service entirely at their own risk, following all given instructions with regard to reheating dishes. CCD will not be liable to compensate the Hirer for any damage or loss of enjoyment in respect to the Hirer's holiday if the reason for such

damage was the fault of the Hirer, or could have been reasonably foreseen. CCD’s liability in any event or loss (including both direct and indirect loss of enjoyment) will not in any event be greater than the Full Payment. In the case of food deliveries, once the meal has been left at the client’s property, it is the responsibility of the client to follow the given instructions for re-heating, and proper storage of the food as advised. Responsibility for storage of the food ends once CCD has placed the delivery in the fridge (or as appropriate) at the client’s property, and this is recorded via the delivery note.


7.3. Our Liability

We accept responsibility for ensuring that the services offered reach a reasonable standard. Please see Section 11 for conditions applicable in the case of any changes.


8. Deposits and Bookings

A deposit of 10% of the total value of the booking is required to secure the reservation. Deposits should be received within 5 working days of the provisional booking. Provisional bookings will be cancelled if the deposit is not received with this time period. Binding confirmation of the booking can only be made once all appropriate deposits have been received.


9. Payments

Full Payment must be made a minimum of 4 weeks (for independent Services) before the Hire Period commences. The Hirer is responsible and liable for all persons who payments apply to.


10. Cancellation

If the Hirer decides to cancel the services, they must inform CCD in writing. Cancellations will incur administration costs and will lessen the likelihood of being able to resell the services, therefore the following cancellation charges will apply:

For Services

More than 4 weeks before due commencement of Services: Loss of Deposit

4 – 3 weeks before due commencement of Services: 25% of Full Payment

3 – 2 weeks before due commencement of Services: 50% of Full Payment

2 – 1 weeks before due commencement of Services: 75% of Full Payment

Less than 1 week before due commencement of Services: 100% of Full Payment

In addition to the cancellation charges, CCD reserves the right to pass on any charges made by the suppliers of any services booked by us on your behalf. Depending on your circumstances and reasons for cancellation, you may be able to claim these charges back from your insurance company.


11. Cancellation by CCD

We reserve the right to make minor alterations to the website and service details before and after bookings have been confirmed. In the case of a minor or significant alteration being made we will advise you at the earliest possible date. In the event of a significant alteration, you may accept to cancel your holiday and receive a full refund. CCD will pay no compensation.

If it is necessary for us to cancel a confirmed booking we must reserve the right to do so. If we do so you will receive a full refund of all monies paid. We accept no legal liability and will pay no compensation. Very rarely we may be forced to curtail your booking after the date of Hire where circumstances amounting to 'force majeure' occur. In this very unusual situation, we regret that we cannot make refunds (except where refunds are made from a supplier), meet any cost or expenses you may incur as a result or pay any compensation.


12. Force Majeure

We regret we cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected by 'force majeure'. In these booking conditions, 'force majeure' means any event which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events may include, but are not limited to: war or threat of war, riots, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside our control.


13. Complaints

In the unlikely event you have reason to complain, The Hirer must immediately inform a member of staff. By letting us know early, there is a much better chance that we can rectify the situation and you can get on with enjoying the remainder of the holiday. If you are still unhappy with the resolution, you must inform us in detail, in writing. This must be received within 7 days of the end of the Hire Period. If the complaint is received outside of this time, or if it is not brought to our attention as soon as reasonably possible, we will be unable to process it, and cannot accept liability. Elements not covered by this include, but are not limited to: weather, third parties, snow condition, unforeseen cancellations or closures, force majeure.


14. Entire Agreement

This agreement, the Terms and Conditions as stated on the website, together with documents stated herein constitute the entire agreement between the parties with respect to the subject matter of this agreement. This supersedes and extinguishes any prior drafts, agreements and undertakings between the parties relating to such subject matter.


15. Rights of Third Parties

A person who is not a party to this agreement has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce, or to enjoy the benefit of, any provision of this agreement.


16. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of England and the parties hereby submit to the exclusive jurisdiction of the English courts.


17. Acceptance

As part of CCD acceptance of the booking, the Hirer warrants to CCD that all information provided to CCD is correct and that the Hirer is aged 18 years or over.


20. Travel and Delays

We cannot accept any responsibility for any travel arrangements made. We cannot compensate you for delays out of our control, for example (but not exclusively), the delays of flights, trains, or ferry crossings, or road closures. But we do endeavour to be flexible, so the sooner you inform us of any problems travelling, the better the chance we can help. If delays mean you need to make alternative arrangements, we will not compensate any charges. However your insurance policies may cover you in certain circumstances.


23. Prices

At the time of writing, every effort has been made to ensure all prices mentioned are correct, however we cannot guarantee they will not change, and cannot accept any responsibility of offer compensation if they do.
